WORKSHOP TOPIC:  "Themes from Co-Mediating Difficult Family Cases"

PRESENTERS:  Brad Honoroff, J.D.; Jane Honoroff, LICSW, MSW; and Jeff Fraser, J.D.

WHAT YOU'LL LEARN:

At The Mediation Group (TMG), we have utilized a co-mediation model for many years for the vast majority of our family mediations. Our model is to have one lawyer and one mental health professional make up the team. Not only does that bring the benefit of the two disciplines to better assist our clients, but it allows the mediators to learn from each other and develop joint approaches to high-conflict divorces and difficult adult sibling disputes.

We would like to use this session to explore three themes from our experience in approaching these disputes, with examples drawn from actual (though disguised) cases. The lessons learned can be applied by solo mediators of any discipline as well as of course by co-mediation teams. The three themes for the day are:

  1. recognizing when parties are locked in recurring patterns of dysfunctional arguments preventing them from reaching resolution;
  2. the surprising power of reciprocity in allowing parties to be heard and to move on; and
  3. dealing with the spectrum from personality disorder to acute mental illness and knowing the limits of the process.    
     


ABOUT THE PRESENTERS:

Brad Honoroff, J.D., has mediated thousands of cases across the full spectrum of civil disputes including injuries of all kinds, employment, commercial disputes, business and insurance matters, environmental, intellectual property, health care and family disputes. He specializes in emotionally charged as well as complex, multiparty cases. Brad spent many years as a tenured professor at the UMass Boston Graduate Program on Dispute Resolution and currently serves on the Massachusetts court panels as well as national mediation panels. He is a founder of The Mediation Group.

Jane Honoroff, LICSW, MSW (Simmons), has been a practitioner in the mental health and social work field since 1969 and a mediator since 1984. She is a founding partner of The Mediation Group (TMG). Jane also conducts a private psychotherapy practice. 

As a principal of TMG, Jane specializes in mediating family issues such as divorce, post-divorce, nontraditional family issues, family business, adult sibling disputes and estate settlement. She also handles most of the intakes for TMG’s family mediation program.

Jeff Fraser, J.D. (Boston College Law School), is a practicing lawyer at Fraser & Associates LLC in Newton. He has over 40 years of experience in private practice including personal injury, divorce, wills, probate, business, and real estate law.

Jeff has worked as a professional mediator since 1994. He has extensive mediation experience in all types of civil cases. Jeff has also mediated numerous cases involving divorce, estate, adult sibling, and family disputes. He has co-mediated many divorce and high conflict cases, working in a team with a therapist/mediator, and is very familiar with both the legal issues and the emotional dynamics arising in divorce, multiparty estate cases, and family business disputes.
