WORKSHOP TOPIC:  "Informed Consent:  Mediation of Alimony in a Changing Environment"

WHAT YOU'LL LEARN:

What's old and what is new in Massachusetts alimony practice? Where has alimony "reform" created clarity and how not? What is the impact of congressional challenges, from changing tax rates and deductions, to the existential threat of eliminating deductibility? How does alimony interact with child support? What are the special challenges of unallocated support? What happens when gross income is net income?

And, how does all of that work in the mediation room?

This discussion will focus on translating a basic understanding of alimony in its many dimensions to everyday practice, especially in relation to the twin goals of enhancing clients' knowledge and bolstering informed consent in a highly technical area, while focusing them on optimizing economic outcomes for their families. We will explore the gray area between "information" and "advice," how to explain complex matters simply, the essential use of cash flow projections and the use of technology to make intangible concepts more concrete and accessible.

 

ABOUT THE PRESENTER:

Mr. Levine is private dispute resolution provider, servicing couples and their counsel exclusively as mediator, conciliator, arbitrator and special master, for the last six plus years. After 33 years of law practice in Boston, providing family litigation services (negotiation, trial and appeals) in complex financial and child custody cases, while also mediating and arbitrating cases, he began Levine Dispute Resolution Center LLC with his professional and life partner, Hon. E. Chouteau Levine (Ret.)

A Fellow of the American Academy of Matrimonial Lawyers since 1987, and of the Academy of Professional Family Mediators since its inception, Bill is an Advanced Practitioner of APFM, former National Arbitration Chair of AAML and past President of the Massachusetts Chapter of AAML. He has been recognized by Best Lawyers since 1995, first in Family Law through 2011, and in Arbitration, Mediation and Family Law Mediation ever since and honored as its 2015 Family Mediation Lawyer of the Year; and by Super Lawyers every year since it began, again in Family Law, then since 2012  in their category, Alternative Dispute Resolution.
